Senior Associate - Construction

These are exciting times at ARAG Law as we are experiencing a period of change and sustained growth across our Legal teams.

Our Commercial Litigation team is part of our larger Complex Litigation function and comprises a highly skilled and supportive group specializing in intermediate and multi-track commercial claims across a broad spectrum of policyholders. They also handle wider commercial litigation cases as demand requires.

Due to the expansion of this Commercial Litigation offering, we have a newly created opportunity for a Senior Associate specializing in Construction disputes. The role involves autonomously managing a varied caseload of contentious intermediate and multi-track value commercial and personal construction disputes, from receipt to conclusion.

Reporting to a Principal Associate, you will supervise and mentor junior colleagues to develop their technical construction knowledge, delegating work accordingly.

We are passionate and enthusiastic about our work, with a genuine commitment to giving our team early responsibility. You will often run cases from inception to adjudication, arbitration, mediation, or litigation.

Key responsibilities include:

  1. Assessing prospects of success in your caseload and effectively communicating advice to clients.
  2. Undertaking dispute resolution activities, including negotiation, adjudication, and arbitration.
  3. Litigating in the County Courts, High Court, and Technology & Construction Courts.
  4. Quantifying claim values, referencing expert evidence when needed.
  5. Providing advice on specific JCT contract issues arising from standard form contracts used in construction, including JCT, NEC, and ICE contracts.

This role can be hybrid—minimum 2 days per week in the office—if you live within a commutable distance of either our Bristol City Centre office (5 minutes’ walk from Temple Meads station) or our Bedwas office in South Wales.

We will also consider fully remote candidates if you live too far to commute, depending on your experience level and ability to work remotely.

This can be a full-time or part-time role (minimum 4 days a week or equivalent hours).

This is an exciting opportunity for an existing Senior Associate or an Associate eager to grow in a collaborative, supportive environment. Essential is significant experience in construction litigation (both personal and commercial) and a strong understanding of the Civil Procedure Rules, including pre-action protocols. Experience resolving cases via adjudication, arbitration, court proceedings, mediation, and ADR is also required, along with exposure to commercial construction concepts such as quality issues, suspension notices, payment issues including Pay Less Notices, Variations, and Delays.
