Senior Lawyer - Water Industry Enforcement Team - 31834

The Environment Agency’s legal teams handle criminal proceedings and advise on enforcement of environmental requirements. They also advise on civil sanctions such as enforcement undertakings and variable monetary penalties, and provide training on disclosure requirements and the use of statutory and enforcement powers.

Responsibilities

• Conduct criminal proceedings and advise on enforcement of environmental requirements.
• Advise on the imposition of civil sanctions, including enforcement undertakings and monetary penalties.
• Provide staff training on disclosure requirements and the use of statutory and enforcement powers.
• Own an interesting caseload to support the Water Industry across the organisation.
• Travel to court and other locations as required; roles may be based at main hub locations. Attend the contractual office base in line with business needs and flexible working patterns.

Experience and Qualifications

  • You will be a qualified solicitor, barrister or equivalent (FILEX with rights of audience in criminal proceedings).
  • Ideally experience as a prosecutor or defence lawyer of complex criminal cases concerning breaches of environmental legislation or other complex areas of criminal and regulatory law.
  • Sound knowledge of criminal law, practice and procedure; experienced criminal advocate with trial experience in the Magistrates’ Court. Experience in preparing complex cases for trial and sentence in the Crown Court.
  • Higher rights advocate status is not required but may be an advantage. You should understand the Environment Agency’s use of civil sanctions in place of criminal proceedings and be able to advise on the right regulatory response to environmental offending.

Additional Information

  • Salary: Market Forces Factor allowance of £5,250 per annum.
  • Location: Roles based at any main hub locations; West Midlands region in Birmingham area is referenced; there may be travel to court and other locations.
  • Work pattern: Home working combined with attendance at the contractual office base; flexible working patterns including job share are welcome.
